A breakthrough for the market’: Europe’s highest court rules CBD is not a narcotic

Until this decision,  all novel food applications for non-synthetic cannabinoids—including CBD—had been frozen and would not be reviewed by the European Food Safety Authority (EFSA). However, this changes Europes approach to CBD drastically.

This is a breakthrough for harmonisation across the European CBD market. Until this decision was made, it was only the UK that considered CBD not to be a narcotic. Although France has currently prohibited the sale of extracted CBD products from the whole plant, it is likely that in the future, due to the free movement of goods within the EU provision, it will no longer be able to prohibit the sale of CBD products lawfully produced in another member state.
