ASA adopts a hard line on hard seltzer ads

All 4 businesses were penalised uncer CAP Code Rule 15.1, which states that only specific health claims authorised on the GB nutrition and health claims register are permissible in marketing communications and Rule 18.17, which prohibits the inclusion of health, fitness and/or weight-control claims in alcohol ads. In addition, one company promoted the excessive consumption of alcohol, which is also not permitted.

 

Food Labelling Services comments:

Health and Nutrition Claims are strongly reulated and only permitted claims that are listed on the Nutrition and Health Claims Register (NHR) can be declared. For alcohol products, the controls are stricter, and the only permitted nutrition claims are “low-alcohol”, “reduced alcohol” and “reduced energy” and any claim likely to have the same meaning for the consumer”. Nutrition and Health Claims are exceptionally complex, and expert advice should be sought when declaring these claims, to prevent beaking the Nutrition and Health Claims Regulations.
