The exemption for trademarks, brand names or fancy names that were registered before 1st January 2005 will end on 19th January 2022. After this, all trademarks, brand names or fancy names will have to compy with the provisions of the NHCR. This means that if a trademarks, brand names or fancy names could be construed as a nutrition or health claim, they can be used if sustained by accompanying permitted nutrition or health claim as appropriate.
